2.4 Product Labeling

2.5 Sales Restrictions
In accordance with the Act:
(a) Our products may only be sold directly to informed final consumers. An "informed final consumer" is an individual who purchases directly from the producer, does not resell the product, and has been informed that the product is not certified, licensed, regulated, or inspected by the state.
(b) Our products are for personal or home consumption only and are not for resale.
(c) Our products may not be sold to, or used by, restaurants or commercial establishments.
(d) All products must be produced and sold within the State of Utah.
2.6 Business License Compliance
Notwithstanding the exemptions provided under the Act, Bella's Bread maintains a valid business license as required by Utah Code Section 10-1-203.

(b) Products that have been partially consumed (beyond reasonable inspection);
(c) Dissatisfaction with taste, texture, or appearance that falls within normal variation for handmade baked goods;
(d) Products that were not stored according to our recommended storage instructions;
(e) Failure to receive delivery due to customer unavailability or incorrect address provided by the customer;
(f) Orders not picked up at the agreed-upon time and location; or
(g) Claims made more than twenty-four (24) hours after delivery or pickup.

YOU AND BELLA'S BREAD AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Bella's Bread agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
10.6 Small Claims Exception
Notwithstanding the foregoing, either party may bring an individual action in small claims court in Salt Lake County, Utah, if the claim falls within the court's jurisdictional limits.
10.7 Equitable Relief
Notwithstanding the foregoing, Bella's Bread may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information without first engaging in informal dispute resolution, mediation, or arbitration.
10.8 Limitation on Time to File Claims
ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR PURCHASE OF PRODUCTS FROM BELLA'S BREAD MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
